California's New Workplace Violence
Prevention Law - How Will It Affect You?

Back in September, Senate Bill No. 553 was signed in to law. From this bill came the California Labor Code Section 6401.9  known as the new Workplace Violence Prevention Law.

The update requires California businesses to establish, implement, and maintain an effective Workplace Violence Prevention Plan. The deadline for implementing such a plan is July 1, 2024. If you're a California business owner, what does this mean for you?

Exemptions

employers with fewer than 10 employees who are not accessible to the public
employees that are teleworking and not under employer’s control
employers with healthcare facilities
certain public entity employers.

What is workplace violence?

Per the Labor Code mentioned above, "workplace violence" is defined as any act of violence or threat of violence that occurs in a place of employment, but does not include lawful acts of self-defense or defense of others.

What must be included in a Workplace Violence Prevention Plan (WVPP)?

Identify who is responsible for implementing the plan
Actively involve employees
Accept and respond to reports of workplace violence
Prevent employee retaliation to workplace violence
Communicate with employees regarding workplace violence matters
Respond to actual and potential emergencies
Develop and provide effective training
Perform incident response and investigations post incident
